2. Topiary Communications, Inc. shall have no obligation to provide the Services, and shall have no liability to the End User in the event Topiary Communications, Inc. is unable, as may be determined in the sole discretion of Topiary Communications, Inc., to grant access rights to End User.
3. Topiary Communications, Inc. shall not be liable to End User for any consequential or incidental damages arising from the breach of any of the terms and conditions contained in this Agreement.
4. End User agrees to indemnify and hold Topiary Communications, Inc. AND Topiary Communications Inc., its affiliates, officers, directors, share holders, and employees harmless from any claim, action, demand, loss, or damages (including attorneys' fees) made or incurred by any third party arising out of or relating to End User’s use of the Service.
5. Any and all information that End User is accessing via this application is either the property of Topiary Communications, Inc. AND Topiary Communications Inc. and shall not be shared with any third-party without written consent of Topiary Communications, Inc. AND Topiary Communications Inc.
